Recently, there are more and more foreigners who need to apply for stay permits in the Immigration Service Hall. Some of them are allowed to apply for the permits, while others are denied. For a long time, the stay permit for foreigners in China has been a humanitarian visa type that foreigners can apply for at the Immigration Service Hall under the jurisdiction of their residential areas, which empowers them to stay in China for a short time.

For example, if a foreign student in China needs about a month to pack luggage and purchase air tickets after graduation from a school, the school may apply for a month stay permit for him/her in 10 working days before his/her study residence permit expires.

For example, when applying for a work residence permit, if the valid visa on the personal passport expires before the Notification Letter of Work Permit or the work permit is approved, relevant documents can be prepared and handed in to apply for a month stay permit.


CONDITIONS

In general, foreigners who have one of the following circumstances may apply for a stay permit:

(1) Foreigners who enter visa-free entry need to continue to stay beyond the visa-free period due to non-diplomatic or official reasons;

(2) Foreign crew members and their family members need to leave the city where the ship is at the port of call;

(3) Those who have withdrawn their Chinese nationality upon approval and need to stay in China;

(4) The reason for the alien's residence is terminated and the residence needs to be continued due to humanitarian reasons;

(5) Foreign babies born in China need to stay in China;

(6) Other situations where a residence permit is required.

Note: When foreigners stop or stay in China, they must pay attention to the duration of their visas and plans in advance 7 days before the visas expire to avoid overstaying.


REQUIRED DOCUMENTS

The materials required for applying for a stay permit are as follows:

1. Visa Application form affixed with a 2-inch blue background photo (can be printed after an appointment);

2. A valid Receipt of China Visa Photographs for Foreigners in Guangdong Province signed by the applicant.

3. Valid passport or other international travel documents, visa document with seal for this last entry (please mark with arrows).

4. Valid Registration Form of Temporary Residence for Visitors, original and copy;

5. For nationality identification, a child under the age of 18 applies for a visa in Guangdong with a foreign passport for the first time, he/she must submit a copy of his/her birth certificate and the foreign passport of the foreign parents; Copies of passports and documents such as obtaining permanent residency in the country of residence are needed to submit if one or both parents are Chinese nationals. Those who are identified as having Chinese nationality can apply for entry-exit passes in accordance with relevant regulations.

6. Letter of proof (guarantee) of applying for Visa Certificate issued by the employer;

7. Other materials related to the reasons for the application:

(1) For visa-free entry, provide supporting materials related to the purpose of stay;

(2) Crew members and their families are required to provide seafarers' certificates or other international travel documents, a letter of guarantee from a shipping agency company, a dated plane (vehicle, ship) ticket or other proof materials related to the purpose of stay;

(3) Those who withdraw their citizenship in China also need to provide the "Certificate of Withdrawal of the People's Republic of China" and the supporting materials related to the reason for stay;

(4) If the reason of residence is terminated, provide the residence certificate and the certificate of termination of the reason of residence (such as the original resignation certificate if the work is over, the graduation certificate or the certificate of the end of the study issued by the school, etc.);

(5) Newborns are required to provide birth certificates, foreign passports and valid visas of both parents.

8. Other certification materials that the public security organ deems necessary to submit.

 

CASES

1. If foreign applicants fail to provide sufficient evidences and legitimate reasons for Shenzhen Exit-Entry Administration when they are applying for a stay permit of a longer duration, it can only issue a short-term stay permit which lasts less than 10 days for the applicants to purchase air tickets, which empowers them to depart from China.

2. There are Ukrainian citizens who cannot go back to Ukraine due to unstable political factors such as wars, which strictly prevents them from going back to their own country. Under such special circumstance, Shenzhen Exit-Entry Administration will issue them with a stay permit.

3. If the current visa nearly expires when the foreign applicants is in the process of work transaction or job application, Shenzhen Exit-Entry Administration can issue them with a stay permit if the applicants are able to prove their job application with relevant documents.
